Giveaway Terms and Conditions

By entering this competition (Competition), you (the Entrant) acknowledge and agree to be bound by the following terms and conditions of the Competition (T&Cs). The Competition is a promotion of Learnmate Tutoring Pty Ltd (Promoter).

The Competition is only open to Entrants who are:

  1. 16 years or older;
  2. residents of Australia; and
  3. not currently a customer, student, parent or guardian of a student of the Promoter,

at the time of entry into the Competition.

Entering the Competition and choosing a Winner

To validly enter the Competition, fill out and submit the form provided including any “Required*” fields by no later than 5pm on 30 July 2021 (Closing Date). Any entries received after the Closing Date will not constitute or be treated as valid entries into the Competition and will not be eligible. Valid entries are conditional on the Entrant properly providing the personal information requested and marked as “Required*”.

There is no cost for entering into the Competition and all individual entries carry an equal chance of being drawn. Chances fluctuate based on the overall number of Entrants to the Competition. The winning Entrant of the Competition (Winner) will be drawn by hand at random at midday (12pm AEST) on 31 July 2021 by a representative of the Promoter. No Entrant is required to be present at the drawing of the lottery in order to be eligible to win. The Winner will be published on the Promoter’s website at https://learnmate.com.au/year-of-tutoring-competition for a minimum period of 28 days and advised that they have won by email to the address used to enter the Competition. The Winner must confirm acceptance of the Competition prize by reply email and confirming their eligibility to participate in the Competition within 14 days of being advised of winning the Competition, failing which the Winner forfeits the Competition prize and Promoter may and will substitute the Winner for a new winner drawn via a second draw in accordance with these T&Cs. The Competition prize is not assignable or transferable other than by the Promoter. Any decisions made or actions taken by the Promoter are final and binding.

Any information provided by Entrants in entering the Competition (including name, addresses and phone numbers) become the property of the Promoter and may be used by the Promoter in the usual course of its business, including for future marketing, promotional and publicity purposes in any reasonable and usual form and Entrants consent to such use. Such information shall otherwise be used in accordance with Promoter’s Privacy Policy. Entrants also consent to the publication of their name on the Promoter’s website and socials (as applicable) should Entrant be the Winner of the Competition.

Competition Prize

The Competition prize is for 1 year of tutoring up to a value of $2,500 (Prize), subject to the following terms and conditions:

  • the Prize expires 12 months after the date that the Prize is awarded to the Winner;
  • the Prize is awarded in the form of a credit to the Winner for use and redemption on the Promoter’s platform;
  • the Prize may be redeemed by Winner for tutoring lessons for any year level, subject, private or group tutoring through the Promoter, but always subject to tutor availability and supply for the Winner’s intended use and the Promoter provides no guarantee as to such availability and supply; and
  • the Prize is not claimable, payable or redeemable in cash and any unused balance expires on expiry of the Prize.

Other

Promoter is not responsible for any incidental, direct or indirect costs incurred by an Entrant in entering into this Competition, or the Winner in redeeming the Competition Prize, which remain the sole responsibility of the Entrant and/or the Winner respectively.

Promoter makes no representation nor provides any guarantee or warranty as to the availability of a suitable tutor or tutors for the purpose of tutoring the Winner (or the Winner’s child) in order to redeem the Competition Prize. It is the sole responsibility of Winner to ensure that Winner (or the Winner’s child) has the required computer, internet connection, materials and/or availability to participate in tutoring to redeem the Competition Prize.  If there is no suitable tutor availability for you to redeem the Competition Prize, please contact the Promoter.

Entrants release, defend and hold harmless the Promoter and its affiliated companies, officers, directors, agents and employees (Promoter’s Representatives) from all claims and liabilities relating to their participation, acceptance and use or misuse of the Competition Prize. Entrants acknowledge and agree that the Promoter and the Promoter’s Representatives do not make and are in no way responsible for any warranty, representations, expressed or implied, in fact or in law, relative to the conditions, fitness, merchantability or quality of any aspect of the Competition Prize. None of the Promoter or the Promoter’s Representatives are in any way responsible for any (a) lost, late, unsubmitted, not received, incomplete or illegible Competition entries; (b) error, omission, mistake, defect, delay or fault in any operation or transmission, technical, network, telephonic problems or issues on the internet, the Promoter’s website or otherwise; or (c) any injury, damage or issue caused to the Entrant’s (or any other person’s) computer related to or resulting from participation by Entrant in the Competition.

Promoter may abandon the Competition or method for selecting a Winner if the Competition submission database or submissions become unreasonably or irreparably corrupted or malfunctions.

No director, manager, employee (and any of their immediate family members), retailer, supplier, associated company or agencies of the Promoter can participate in the Competition.

Any disputes arising in connection with the Competition shall be governed by the laws and courts of the State of Victoria and Entrants agree that any and all disputes shall be litigated only in courts in the State of Victoria.

The Competition is being conducted in accordance with the Gambling Regulation Act 2003 and Gambling Regulations 2015 and is subject to all applicable federal, state and local laws and regulations.
